Being an employer failed to provide a system of work such that, so far as is practicable, his employees are not exposed to hazards.

Background Details:
On 24 September 1996 it was observed at the defendant's workshop that an employee was elevated on a pallet, attached to a forklift truck, to a height of between 4 to 5 metres. Alongside the employee, on a pallet, was a CIG oxyacetylene unit. The employee was wearing a welder's helmet, with the visor in the raised position, and no harness or fall arrest equipment was attached to him. The employee was welding a beam to the rafters.

Management were approached with a view to stopping the activity until a safe method of carrying out the work could be arranged. Subsequently a scaffold was hired to complete the work.
