Being a self-employed person at a workplace where demolition work other than specified demolition work was being done, failed to ensure that the work was done in accordance with AS 2601 in that he failed to ensure that services within the structure not required to be maintained during the demolition work were properly disconnected and sealed off before any demolition commenced.

Background Details:
The defendant was a demolition contractor who was undertaking the demolishion of a single storey house in West Perth. On 3 March 2000, a WorkSafe Inspector inspected the site and asked the defendant whether the power had been disconnected. The defendant assured the inspector that it had been disconnected.

On 13 March 2000, after receiving a complaint, two other WorkSafe inspectors visited the site. Inquiries with Western Power revealed that the underground power to the house had not been disconnected. It had not been capped at the entry point to the house and was still live. The defendant had made an application to have the power disconnected on 25 February 2000 but it was not possible to have that done straight away because the power was from underground cables. In order to disconnect the power some excavation with necessary and Western Power needed to provide a quote in relation to the cost, which was provided on 7 March 2000.

The defendant pleaded guilty. Mr Heath SM made a spent conviction order.
