Being an employer, failed to provide and maintain, so far as was practicable, a working environment in which its employees were not exposed to hazards.
Background Details:
The investigating inspector observed several persons working adjacent to an open edge of a roof on a construction site. The inspector observed that there was no edge protection and none of the persons working near the roof edge were wearing fall arrest harnesses.
The defendant was on site and in a position to observe his employees working at height without edge protection or a fall arrest system in one area of the work being undertaken.
This incident was also the subject of prosecution action against the main-contractor, Brown & Joy Industries Pty Ltd
The defendant pleaded not guilty.
